To avoid misunderstanding and anything that may raise dispute in the future, calibrehosting.com firstly enters into an agreement with the Customer. This agreement is made and agreed between calibrehosting.com located in Bogor, West Java, Indonesia and the Customer that subscribes to services we provide. Both parties agree to be bound by the following terms and conditions:
calibrehosting.com provides web hosting services and other services related to the Internet. calibrehosting.com provides technical support for its services during business hours and business days. This support can be delivered via e-mail, telephone call, or visit to the Customer site. The Customer can use the hardware and software in the servers provided by calibrehosting.com to make its web site accessible through the Internet by selecting type of service and features offered by calibrehosting.com on lease basis after previously getting confirmation from calibrehosting.com. calibrehosting.com guarantees that every customer shall obtain the following common facility: a control panel to configure customer account, including file manager, email manager, subdomain manager, WebMail installed, etc.
In using the server(s) of calibrehosting.com, the Customer shall not:
» Try to damage and or change the server data and configuration that are not owned by the Customer;
» Use the server(s) to try to access, damage, and or change the system data and configuration of server(s) owned by a third party;
» Present any pornographic contents (both softcore and hardcore, both graphic or textual) and any materials that support pornography at the Customer web site;
» Send unsolicited or spamming e-mail(s) in bulk or small size delivery containing news, product offerings, product promotion, etc.
» Run a background process and server daemon such us IRC bot, rc5des, Java Chat Server, etc.
» Run a resource intensive program that consumes a lot of computer memory and CPU time that can be harmful to the stability of server(s).
» Store other materials that violate the local law or infringe copyright, including but not limited to illegal copies of audio files in MP3 format, unauthorized copy of the content of other web site, etc.
calibrehosting.com has the right to issue a warning to the Customer or terminate immediately the running of email delivery program(s) owned by the Customer that disrupt or degrade the activities of the server(s) or other Customer.
calibrehosting.com is not responsible for the content of the Customer web site. The Customer is solely responsible for the Customer web site. calibrehosting.com does not guarantee the accuracy and the completeness of the content of the Customer web site. calibrehosting.com is not responsible for any consequences resulted from the content of the Customer web site. Any unfortunate events such as data deletion, site cracking or defacement resulted from the Customer negligence or oversight, or from any program or script installed at the Customer web site shall not be the responsibility of calibrehosting.com. calibrehosting.com issues warnings and suggestions for its customers periodically to maintain security. calibrehosting.com, however, is not responsible for any event at the Customer web site.
calibrehosting.com is obliged to provide service support to the Customer in relation to the account owned by the Customer, including password changes, file attribute changes, email setup, and configuration of server owned by the Customer. calibrehosting.com does not provide services such as creation and debugging of script (e.g. CGI) or program (e.g. PHP code). The service support is provided by calibrehosting.com via telephone during the business hours and days and via email for 24 hours.
calibrehosting.com gives assurance of early notice (between 24 and 48 hours in advance) via email for these events: server restart, server relocation to other data center, change of DNS, change of IP address, and other critical events.
calibrehosting.com has the right to register a domain on behalf of the Customer when so requested by the Customer. All administrative and payment processes in relation to the domain name are carried out by the Customer unless calibrehosting.com agrees to assist.
The registered domain name is fully owned by the Customer. calibrehosting.com shall not be held responsible for any consequences resulted from the registered domain name because calibrehosting.com only acts as a registration intermediary. calibrehosting.com is not responsible for the existence of the Customer domain name in the future when it becomes non-functional due to faults or negligence made by the Customer, attacks from hackers, problems with the main registrar in USA, or any Internet revolution that is beyond our control. There shall be no loss or damage claim to be carried by calibrehosting.com. Any costs related to the domain name shall be borne fully by the Customer.
The Customer agrees to use the services and facilities of calibrehosting.com and accepts all the risks resulted from that usage. calibrehosting.com shall not be responsible for any data loss or damage, including those resulted from usage of calibrehosting.com facilities. calibrehosting.com is freed from any claim by a third party made due to any loss suffered by that third party.
The Customer has the full responsibility to do backup of the Customer own web data. calibrehosting.com is freed from any indemnification upon any harm or loss resulted from failure to do backup. Any backup carried out by calibrehosting.com is for internal use only.
The Customer shall pay services provided by calibrehosting.com through accepted payment method and in the sum as specified by calibrehosting.com at least 15 (fifteen) days after the date of invoice that is sent via email or other method. If the payment is not received within the aforementioned period, calibrehosting.com reserves the right to suspend the Customer web site without further notice. If the payment is not received within 45 (forty five) days after the date of invoice, calibrehosting.com reserves the right to delete all the Customer data in the server without further notice. Any payment made to calibrehosting.com is not reimbursable by any reason if the Customer decides to cancel the contract.
calibrehosting.com protects personal data of the Customer, such as the source code of scripts that are not shareable to a third party, database, or data in the home directory of the Customer that is not to be seen by other users, that it is not obtained freely, except when the Customer deliberately sets otherwise. calibrehosting.com shall not access the file directory of the Customer unless it is requested by the Customer, and shall not pass the data to a third party unless required by law.
We appreciate the resellers and their privacy. We guarantee that each reseller gets:
» Full anonymous service: your customers will never know that you use our services.
» Secured contact: calibrehosting.com will never contact a customer of a reseller directly by any means, except in emergency situations, such as server down time and restart notification. If such emergency contact is made, the identity of calibrehosting.com will not be revealed.
» Technical support: calibrehosting.com will provide this to ensure reseller’s smooth operation.
calibrehosting.com reserves the right to terminate unilaterally a contract with the Customer if the Customer fails to observe terms and conditions set out in this agreement.
If the Customer wants to terminate a contract unilaterally, the Customer cannot reclaim whatever payment the Customer has made.
calibrehosting.com reserves the right to make amendment to this agreement at any time it deems necessary without prior notice to the Customer.
This agreement is written using terminology that is commonly used in the field of Internet and Computer Communication and that is fully understood by calibrehosting.com and the Customer.
calibrehosting.com creates this agreement for the benefits of both parties, which is to protect calibrehosting.com from illegal activities and to allow the Customer to enjoy the most optimum services.
If the Customer conducts violation s to this agreement, calibrehosting.com has the right to give warning via e-mail, telephone, or fax. If, after being warned, the Customer continues the violations, calibrehosting.com has the right to terminate the shared hosting account of the Customer without prior notice and the Customer cannot reclaim the service fee. For very serious violations, calibrehosting.com has the right to apply penalty that must be paid in full by the Customer.
